Apple Clarifies iBooks Author EULA, Excludes Claim on Content

Apple changed the wording on the iBooks Author end user license agreement (EULA), clarifying the company’s restrictions on what can be done with content created with the software. The clarification specifies that Apple is restricting what can be done with the company’s proprietary .ibooks files, and is not claiming the content.

Germany Overturns Injunction, Apple Resumes iPhone Sales

In what’s turning out to be a day dominated by new of Apple and Motorola’s patent fight, Apple has managed to get an injunction suspended that had blocked the sale of the iPhone 3GS, iPhone 4 and iPad 2 with 3G support in Germany. Apple pulled the devices from its online store in Germany earlier in the day to comply with the injunction.

German Court Gives Motorola iCloud Injunction

The Mannheim Regional Court in Germany ruled on Friday that the push email service in iCloud and MobileMe infringes on Motorola Mobility patents and awarded the company an injunction blocking Apple from using the feature, as well as blocking any devices that take advantage of the feature. Assuming Motorola chooses to act on the injunction, Apple would have to stop offering push email service through iCloud and MobileMe in Germany.

Motorola Ruling Halts Some iPhone Sales in Germany

Apple has stopped selling the iPhone 3G and iPhone 4 through its online store in Germany following a ruling that the company is violating wireless communication patents owned by Motorola. Apple’s online store also stopped sales of the iPad 2 with 3G support.

IDC: Apple Overtakes LG as #3 Global Mobile Phone Vendor

Apple overtook LG Electronics in the 4th quarter of 2011 to become the world’s third largest mobile handset, according to research firm IDC. In a report released Thursday, IDC said that Apple grew its December quarter shipments 128% year-over-year, while LG’s shipments declined by more than 42%, allowing Apple to slip past the Korean consumer electronics firm.

Apple Appeals China’s iPad Trademark Rejection

Apple has filed an appeal with the courts in China in hopes of overturning a December ruling that gave the iPad trademark to display maker Proview Technology. The court ruled against Apple after Proview claimed it hadn’t been involved in the negotiations to transfer the iPad name rights when Apple arranged the deal in 2010.

Germany Upholds Galaxy Tab 10.1 Tablet Ban

Samsung took another kick in the pants on Tuesday when a German court ruled to uphold a sales ban on the Galaxy Tab 10.1 and Galaxy Tab 8.9 tablets. Unlike the original appeals court ruling that banned the tablets because they matched the design of Apple’s iPad too closely, the higher court based its ruling on German unfair competition laws.

Analyst: China iPhone Sales May Top 40M in 2013

Apple could sell as many as 40 million iPhones in China alone in 2013, according to Morgan Stanley analyst Katy Huberty. Part of that sales figure assumes Apple will add China Telecom and China Mobile to its partner list, Currently, China Unicom is Apple’s only iPhone partner in the country.

Microsoft Money Buys Wisconsin Schools iPads

The Madison school district in Wisconsin is buying 1,400 iPads for its classrooms, and the cash to land the deal is coming from a settlement with Microsoft. The district is starting by distributing 600 iPads among students and teachers and plans to add another 800 iPads by next fall.
