Apple iPod Battery Lawsuit Challenged

An appeal challenging the settlement in the class action lawsuit regarding iPod battery performance has been filed, according to the Apple iPod Settlement Web site. The appeal, which was filed on October 24, potentially delays affected iPod owners from receiving settlement benefits by up to a year.
Although Apple did not file the appeal, it confirmed that someone had filed one, but declined to comment any further, according to Playlist.
The class action lawsuit alleges that first, second, and third generation iPod batteries do not perform as advertised, and quickly loose the ability to hold a charge.
Remedies in the suit for affected iPod owners include an Apple Store credit, battery replacement, or partial reimbursement for user replaced batteries, depending on which model iPod they own.
