Canada’s "iPod Levy" Dies

Canada’s proposed levy on digital audio recording devices, including Apple’s iPod media player, fizzled out and died on Thursday when the Federal Court of Appeal ruled that the Copyright Board did not have authority to impose tariffs on the devices. Had the Copyright Board gotten its way, Canadian consumers would have seen up to a CA$75 increase in the cost of media players.
Howard Knopf, who represented the Retail Council of Canada in the effort to kill the levy, said on his blog "It took the Court less than 24 hours to render its decision -- which told the Board that the Court’s previous decision on the same issue from 2004 is dispositive."
He added that the court was "very decisive" in its ruling.
