FCC Will Enforce Net Neutrality

The FCC Chairman Kevin Martin told the U.S. Senate on Tuesday that his agency has the authority to enforce Net Neutrality and will use it. No new laws are required.

"I believe that the Commission must remain vigilant in protecting consumers’ access to content on the internet," Mr. Martin testified before the Senate Commerce Committee. "It is critically important that the Commission take seriously and respond to complaints that are filed about arbitrary limits on broadband access and potential violations of our principles."

The Federal Communications Commission is still considering action against Comcast for its filtering of P2P networking, despite the fact that Comcast has recanted and made plans to change its network operations to ensure IP packet agnostic operations. ""Comcast does not, has not, and will not block any websites or online applications, including peer-to-peer services," Comcast reiterated on Tuesday, according to Online Media Daily

Mr. Martin said that the FCC would scrutinize any attempt to regulate traffic. "In a manner similar to the way in which restrictions on speech are analyzed, network management solutions would need to further a compelling or at least an important/legitimate interest and would need to be tailored to fit the exact interest," the Chairman said. "If the concern is about stopping illegal content, a network provider should not block a particular application to all users if that application transmits both legal and illegal content."

In the recent past, there was debate in Congress about Net Neutrality. In general Republicans wanted a minimum of laws and intereference with corporations in the free market. Democrats generally wanted to see equal protection, fearing that some large ISPs would abuse their power. The recent alledged activity by Comcast brought to a head just how ominous the prospects would be if large ISPs were allowed to manage traffic to their own economic gain, and that forced the FCC to step in and exert its chartered authority on behalf of citizens, as Mr. Martin said, without the need for legislaton.
