Apple Agrees to $22.5M Scratched iPod nano Settlement

Apple's ongoing headache over first generation iPod nanos with scratched displays appears to be coming to an end now that a US$22.5 million settlement in a related class action lawsuit has been reached. The settlement gives qualifying first generation iPod nano owners up to US$25, but doesn't require Apple to admit any wrong doing.
The class action suit was filed shortly after the original iPod nano was released and many owners found that the glossy front surface of the device scratched too easily. The suit claimed that Apple misled buyers because it knew the digital media player scratched easily, but failed to disclose that information.
According to an email some first generation iPod owners received, Apple agreed to the settlement that will cover the class action payments along with other legal fees and expenses. Any money left over after settlement payments have been made will be given to court-approved charities.
iPod nano owners hoping to participate in the settlement must complete a claim form by June 10, 2009. The form is available at the settlement Web site, or by calling 1-888-232-3395.
The settlement was tentatively approved by the Superior Court of the State of California, County of Los Angeles. A fairness hearing is scheduled for April 28, and the deadline for objecting to the settlement is March 27, 2009.
