Apple to Sue Palm Over iTunes? Maybe Not
Tuesday, June 2nd, 2009 at 8:48 AM - by Jeff Gamet
The Palm Pre shares some similarities with Apple's iPhone, and can even sync music from iTunes leading to speculation that a legal battle between the to companies is inevitable. Suing Palm over iTunes compatibility, however, isn't a sure thing -- and may not happen at all, according to Investors.com.
Apple's push to make all iTunes Store music DRM-free, essentially opening up the music download service to all compatible music playback devices, could be part of the reason the company wouldn't sue Palm over the issue.
"I don't believe Apple will do anything," said Tim Bajarin, president of the tech consulting company Creative Strategies. "It's purely DRM-free content that I am free to move anywhere."
Leaving iTunes compatibility off the table doesn't necessarily mean Apple won't consider suing Palm over the Pre smartphone. Apple's insistence that the company will defend its intellectual property seems focused at the Palm Pre, and the device does share many similarities with the iPhone.
Apple hasn't said if it plans to go after Palm in court, but it hasn't made any overt moves yet. The Palm Pre is set to go on sale on June 6.
