Lawsuit Claims Apple Knew About nano Defects

The Law Firm representing Jason Tomczak in a proposed class action law suit against Apple for defective iPod nanos has issued a statement detailing the complaint. The suit, filed on October 19, alleges that the resin coating on the surface of the iPod nano is defective, which results in excessive scratching, and that Apple may have been aware of the problem before the product shipped.

The lawsuit also claims that Apple intentionally misled consumers by showing Steve Jobs pulling a nano from his jeans pocket, implying that they are durable and won't scratch easily.

Mr. Tomczak stated that his fist nano scratched so easily that the screen was unreadable after a few days. Since the battery was also malfunctioning, he returned it to Apple in exchange for a new one. His second nano also scratched easily, so he returned that one as well, but Apple charged him a US$25 return fee.

The law suit goes on to explain that Apple removed some complaints about the nano from its message boards, and has locked some discussion threads about the nano, preventing consumer discussions about nano problems. It also states that Apple advised nano owners to buy a protective case or cover to prevent the screen from scratching.

A quick check of Apple's web site led us to an iPod nano tutorial that states "Smaller than an iPod mini and thinner than an iPod shuffle, iPod nano slips comfortably into a shirt or hip pocket," but does not mention the need for a protective cover.

As a part of the proposed class action law suit, Mr. Tomczak is requesting restitution for damages, including refunds for nanos and the $25 return fee, along with attorney's and legal fees.

Is this just a bad production run on a certain day or something that only affects a small number of nanos?

I have examined iPod nanos in several stores, Best Buy, Fry's, Apple Retail. They all had scratches, but not deep and no more than you would see on any such product that could be handled by the public. I tried to scratch it some of them with my fingernail, and I could see where I scratched it, but I could polish away with my thumb.

Another nuisance lawsuit. This guy should be ashamed. No consumer item on earth will remain unscratched if you carry it in your pocket. Apple has already agreed to replace any with obviously defective screens. This is pathetic. He carried it in his pocket, it got scratched, and now how he wants a cut of iPod profits?????? Oh, and a new nano too.

Hmmm, my CAR gets scratched during normal use..... maybe Honda will give me a new one!Plus a cut of every car they sell from now on, of course...

Hmm...then I must have a magic cell phone.

I'm not saying this guy has a case...it could still be total BS...but there certainly are electronic products you can carry in your pocket without getting a damaged screen. My Nokia is one of them.

Granted, it gets SOME scratches, but that's not the complaint. He says that it becomes impossible to read the screen which I've never had a problem with on my cell phone.

Again, I'm not saying this guy is telling the truth (or that he deserves anything for it). But if he IS telling the truth then this is a problem that needs to be fixed. That shouldn't be happening.

Seriously, we know some ("a small number") of the Nano's have bad screens, and Apple said immediately (almost) that they would replace those. So what's the basis for a lawsuit? If this guy can prove he never had anything else in the pocket with the Nano, maybe he has a case.. yeah, on what planet exactly?

SWC, I know your cell has some scratches on it, and I'll bet it's not glossy black either. This guy, at the drooling behest of his shyster lawyer, is just looking for a quick score- a quick payoff to make him go away. It's disgusting, but it's also to be expected in this society of ours.

Class Action suits? Oh yeah. Those are the one's where a Law Firm has a

"client" who suffered some "damage" from a large, heartless Corporation. The suit never goes to trial (settled out of court) and the members of the "class" get coupons for $25 to $100 each to use towards a new purchase and the Law Firm submits a fee claim for Millions of dollars for their hard and tireless efforts. And all it takes is a judge to sign off on the matter. Ah, Justice Prevails. "Get away from my new Porche kid."
