Free iPod Site Faces Privacy Violation Claims

Gratis Internet, which is well-known for its offers of free iPods and other merchandise, sold personal information about 7.2 million users to e-mail marketing company Datran Media, which on Monday agreed to a US$1.1 million fine with the state of New York. Ryan Singel reported for Wired News that Gratis wasn't supposed to sell that information to third parties, per the terms of its privacy policy.

However, Gratis has had its Truste "privacy seal" revoked and reinstated several times, although Truste won't say why. The firm declined requests for comment. "Truste has long been criticized as ineffective and too eager to make apologies for companies that violate the spirit of their privacy promises," Mr. Singel wrote.

Gratis has in the past told Wired News that it never sells private information to third parties. Company co-founder Peter Martin told Mr. Singel: "Appointing a specialized vendor to manage such 'in-house' marketing operations is a commonplace, industry-wide practice. That's what happened here (between Gratis and Datran) and it is a standard and totally lawful practice."

An attorney with the Electronic Privacy Information Center commented: "Every attorney that represents a list broker is going to call their client this week and say, 'This case in New York has made law, and that law says that if you are renting a list you have to make sure the seller's website's privacy policies are legitimate.'"

It was pretty obvious that these guys were scammers. People at the top of the pyramid got iPods, but very few people near the bottom got anything.

What is sad is that Wired news wrote a glowing review about them (they were high on the pyramid so they actually got something), and Gratis used that review to convince more people to join the pyramid.

Now we find (obviously) that they sold the e-mail lists to spammers (this had been complained about by many people who tried the site, of course.)

At least they will have to pay something, but this is probably a drop in the bucket considering all of the addresses they sold to many spam companies.

What is also annoying is that I have seen text ads for freeipods.com etc. on macobserver.com and other "legitimate" mac/ipod news sites!!

I am very disappointed to see scam ads on this site and other sites. ;-(

You are confusing SCAMMER and SPAMMER. They run a legit site -- if you complete the requirements, you get an iPod. I've gotten several and I've watched over 20 friends of mine get them too. (Note, no link here, I'm not trying to get you to sign up). What they did WAS IN THERE TERMS OF AGREEMENT, they just rely on the fact that you're not reading them. Now they might not be spamming you directly, but they will sell your info... but what did you expect?

Still - they are not scammers in that they take your money and run or something. Big difference.

Nope, they're scammers. Lots of people have done *everything required* and gotten *nothing*.

People at the top of the pyramid have 100% success, but it goes down to 1% or less as the pyramid grows...

Many people get rejected for absurd reasons, and if you read Gratis' requirements, they basically say they can change the rules on you at any time.

They are scammers *and* spammers.

A lot of people believed the TRUSTe seal of approval, and were scammed on that end as well.
