Talks To End DRM on EMI Music Stalled

Recent discussions between EMI Group and music retailers were aimed at removing DRM on songs, but an upfront payment agreement couldn't be reached, and talks have stalled according to The Seattle Times on Saturday.

The music retailers included Apple, Microsoft, RealNetworks, Yahoo and Amazon.

EMI wanted an agreement that included a large upfront payment to compensate them for illegal copying, and the retailers presented a counter offer that was lower. An agreement couldn't be reached, and talks have stalled.

The matter is made more difficult because Warner Music has wanted to buy EMI, and Warner's CEO Edgar Bronfman opposes music sold with out the traditional protection mechanisms.

The feeling in the industry is that the first music company to strike such a deal with major music on-line retailers would set a precedent, and the other labels, under pressure, would be compelled to follow suit.

"Ultimately the industry will have to do go down this road," Harold Vogel, a media analyst said. "I would have thought the industry would have been further along at this point."

Meanwhile, overall music sales continue to decline. Many music company executives have hoped that on-line sales would make up for the losses in CD sales. If that doesn't happen, the music industry will eventually be faced with much tougher decisions about how to promote and sell their music.

EMI should just make up its mind. It's facetiously demanding that it get paid for illegal copying, rather than simply agreeing that DRM is pointless (at least to control copying) when unprotected CDs already exist.

Mmm, so EMI are saying, "We know DRM doesn't protect our tracks anyway, but we'd still like you retailers to compensate us"!!! Crazy.

It's worth checking out the recent LA Times article "Another look at Apple and DRM" which has an interesting insight into the powerplay at work behind this, of note is that RealNetworks are one of the retailers mentioned, it appears that the push to go to unDRMed MP3 format is something Real have been pushing as a way around the fact that Apple won't let them in to play.

Oh you guys... Have any of you ever negotiated anything in your lives? The up-front compensation for copying could just as easily be up-front consideration for the rising cost of toilet paper or insurance against all their wives bringing home gonorrhea (note subtle humor for Biff). This is all about price. Assuming that the story is within a stone's throw of accurate though, it does raise a very interesting point. The point is that EMI said it would release the distributors from DRM obligations in exchange for some up front payment, and the distributors countered with a smaller up front payment. Apple was even added to the talks after Jobs' open letter. So what is the interesting point, I hear everyone asking. Well, it's simply that Cory Doctorow and the EFF are full of crap in saying Apple is insincere. Dumbasses (the EFF and Cory Doctorow, not you, the gentle comment readers -- note subtle humor for Biff).

Update:Andrew Orlowski at El Reg has a good column on this, noting the financial turmoil that EMI finds itself in as the reason to ask for up front payment.
