Apple and AT&T Sued For iPhone 3G Defects

A lawsuit filed on Monday in the Eastern District of New York alleges that the iPhone 3G is prone to physical defects and that the AT&T network lacks the bandwidth to support ad claims.
Plaintiff Jai Sen has put together a complaint that cites just about every known consumer issue related to the iPhone 3G according to Information Week: AT&T network issues, the power draw of the iPhone 3G, an e-mail from Steve Jobs to a customer citing a bug, hairline cracks in the plastic case and the Apple ad in the UK banned by the Advertising Standards Authority.
The filing seeks class action status.
As with other lawsuits of this kind, it’s an uphill battle showing that Apple or AT&T intentionally misled the customers and that the particular problems experienced by the plaintiff should apply to all members of a class.
