Dish Network Continues to Stall TiVo Award
Tuesday, March 18th, 2008 at 4:00 PM - by John Martellaro
First, a court awarded TiVo US$74M in a patent dispute with EchoStar/Dish Network. There was an appeal. In January, an appeals court upheld the verdict. Subsequently, EchoStar claimed that a software change invalidated the patent award. TiVo didnt buy that. Now, in a petition filed Monday, Dish Network said that an expert witness who testified for TiVo contradicted himself and seeks a rehearing on the ruling. Meanwhile, interest charges on the original ruling have accrued to US$94M.
Previously, Comcast, Cox, and DIRECTV have come to terms with TiVo in licensing deals.
Thats not the end of Dish Networks troubles. On March 14th, a satellite built by Lockheed Martin and launched from the Baikonour Cosmodrome in Khazakstan by a Russian Proton boster failed to achive the proper orbit. Efforts to move the satellte into the correct orbit have proved unsucessful
The satellite was part of Dish Networks plan to expand its high-definition channel line up. However, there are further launches secheduled that could help Dish Network stay on track with its plans.
