TiVo Moves Closer to $94M Patent Award

In a patent infringement suit brought by TiVo, Dish Network asked for a rehearing from the U.S. Court of Appeals, but the court denied the satellite TV operator’s request on Friday. Previously that court upheld a US$74 million award against Dish Network brought in a suit by TiVo for its Time Warp technology. Now, Dish’s CEO Charlie Ergen says they’ll take the matter to the U.S. Supreme Court.

In March, Dish Network claimed that a witness for TiVo contradicted himself in testimony and asked the Appeals court for a rehearing. On Friday, that request was denied. With interest due, the award is now up to US$94M.

Dish Network has done everything possible to avoid the large payment, including the change of its software. However, the court’s original ruling stands. If the Supreme Court declines to hear the case or rules in TiVo’s favor, it could significantly change the fortunes of both companies.

In a statement, TiVo said: "Today’s ruling brings us closer to resolution of EchoStar’s infringement and reconfirms the strength of TiVo’s Time Warp patent, which is in addition to the other benefits TiVo has to offer. We look forward to full enforcement of our rights in the near term."
