iPod Knock-off Countersues Apple

Luxpro, the company that Apple Computer stopped from selling an MP3 player that looked like a first generation iPod shuffle, is now countersuing for damages. Now that the company has won an appeal in a Taiwan court, it plans to start selling its Super Tangent world wide, and to sue Apple for $100 million in damages, according to the Financial Times.

In March 2005, LuxPro introduced an MP3 player called the Super Shuffle that closely matched the design of Apple Computer's first generation iPod shuffle. Later, the name was changed to Super Tangent.

Apple successfully sued LuxPro in Taiwan court and was awarded an injunction to stop the sale of the Super Tangent. In December 2006, however, Luxpro won an appeal that removed the injunction after Shihlin District Court ruled that "the appearances of the two products are significantly dissimilar."

Luxpro is already selling its player in Latin America and Eastern Europe, and is negotiation with resellers to take the product world wide. And, according to Luxpro's chairman Wu Fu-chin, they company intends to go after Apple, too. "We plan to sue Apple in a Taiwanese court before the end of the month and demand $100 million in compensation for the revenues we have lost due to their abuse of their global power," he said.

Apple Computer was not available for comment, and as a policy does not comment on pending litigation.
