Indy Music Publishers Sue Music Services

A group of independent music publishers filed a law suit against 16 online digital music services for failing to secure proper licensing to sell music downloads. According to Billboard (subscription required), the suit was filed in Federal District Court in Los Angeles in May, and names Apple Computer, AOL Music Now, Buy.com, Microsoft, Napster, RealNetworks Digital Music of California, Record Town, Sony Connect, Virgin Entertainment Group, Wal-Mart and Yahoo! as defendants.
The suit filed by Euro Tec Publishing, Bruce Caplin, Prestoons Music and other related companies claims that the music services, including the iTunes Music Store, did not follow the proper licensing procedures as set forth in the copyright laws. By not following the proper procedure, the suit says, the services failed to meet the copyright requirements and were selling unlicensed music.
Apple was unavailable for comment, and does not discuss pending litigation. The Billboard article is also available at Billboard RadioMonitor.
